FIGHT FOR YOUR RIGHTS AS AN AMERICAN BIKER!
IT IS IMPERATIVE THAT ALL RIDERS PARTICIPATE IN THIS CALL TO ACTION!
We need everyone’s participation in a Call To action.
NHTSA has issued an offer to Law Enforcement agencies to conduct Motorcycle Only Safety Checkpoints (MOSC’s) This program was piloted in the State of New York and we have gotten reports that there have been motorcycles confiscated by the NY DMV during these stops. One case we heard was where the owner went to court and won. The judge ordered the immediate return of the motorcycle, but NY DMV filed a suit against the judge citing that they weren’t sure that they guy was innocent yet, even though a jury found him innocent of altering the VIN numbers. Now this program is in Ohio and California.
The US Defenders and C.O.I.R. have issued a Call to Action to all units and are asking for everyone’s participation whether you are a member or not. We need everyone to either write hard copy letters, send emails or make phone calls to your Congressman, Secretary of Transportation, Ray LaHood, and David Strickland, head of NHTSA (National Highway Traffic Safety Administration). Please read the sample letters, and use what you need. We strongly encourage everyone to write their own letters, but you can edit these and sign you name to them.
After finding the correct person to contact, you may use one of the samples below to make your letter writing easier and faster to create.

There have been some recent events that have come to light about Motorcycle Only Safety Checkpoints (MOSC’s). This project is headed up by NHTSA, which is dolling out federal grant money to law enforcement agencies (up to five) for these “Safety Checkpoints” which resemble the old weigh stations for commercial vehicles.
As you know, motorcycles are not commercial vehicles, and I find this to be extremely discriminatory and make a mockery of anti-profiling laws that were passed.
Representative James Sensenbrenner of Wisconsin has introduced H. R. 1498 supporting efforts to retain a ban on NHTSA’s lobbying of States by withholding federal Highway funds for failing to pass a mandatory helmet law. He has also written a letter to the Senate Committee on Commerce, Science and Transportation urging them to suspend NHTSA’s DTNH22-10-R-00386 program until the concerns of motorcyclist are addressed.
Please support his letter or write one of your own asking the same.
This program was piloted in the state of New York, and is now in Ohio and California. There have been documented cases where the NY DMV confiscated motorcycles because their so-called experts said that the VIN numbers had been altered. One case in particular, went to trial and the judge issued an order to release the motorcycle to him because of the jury’s findings, and the NY DMV filed a suit against the judge. Therefore, this mans property is still being withheld.
In another NY case, two motorcycles were confiscated and sold at auction without notifying the owner, and when he (the owner) called to find out when his court case was coming up, then he was notified. He has now filed suit against NY DMV.
As a concerned US Citizen and registered voter, I cannot abide by this type of enforcement. It seems to me that Federal Tax Dollars would serve the public better by spending it on awareness and education of how to best prevent crashes. There is a study going on right now at the University of Oklahoma that could put that money to good use.

I am writing you to request immediate suspension of the Motorcycle Law Enforcement Demonstrations Grant (DTNH22-10-R-00386). Speaking to you as a long time motorcyclist who rides every day, an advocate for personal freedoms, voter and defender of the Constitution, honestly I find these grants for “Motorcycle Only Safety Stops” to be discriminatory to say the least.
The statistics prove that motorcycle safety and awareness, in conjunction with riders training programs across the country have a far greater impact in reducing injuries and fatalities .The funding the government has set aside would be much better spent in motorist awareness and causation studies, such as the one being conducted right now in Oklahoma.
In Texas, the latest statistics from the Texas Department of Public Safety show a reduction in motorcycle deaths in 2009 by twenty percent. A direct result of our extensive state wide “Share the Road” campaign initiated in 2008. While the number of registered motorcyclists in Texas continues to go up, the number of deaths without helmet use has been reduced from 301 in 2008, to 264 in 2009. Reducing injuries on two wheels is not about helmet use, and we definitely support each states right to determine their own helmet policies.
Sir, it is very clear that singling out motorcyclists for safety stops, equipment checks and law enforcement lectures, does nothing to reduce accidents on motorcycles. The smart approach would be to prevent the accidents from happening in the first place.
The Motorcycle Law Enforcement Demonstrations Grant is an unwarranted use of taxpayer funding that would only allow discriminatory action against motorcyclists. Please suspend the grant offering immediately. I would appreciate a prompt response from you regarding this issue.

Like hundreds of thousands of other freedom loving bikers in the State
of Texas, and the millions of us riding free in America, I have grown
very tired of being considered somehow to be a second-class citizen when in fact I vote, work, and pay taxes like millions of other hardworking Americans; both bikers, and non-bikers alike.
As voting taxpayers, patriots, veterans, entrepreneurial large and small
business owners, professors, teachers, attorneys, physicians,
dockworkers, truckers, and retirees, etc., both statewide, and
nationwide, we have been mobilized by the “US Defender” program to
engage in protecting our God-given and hard-earned rights as freedom
loving bikers. And thus please note that we are indeed a very, very
large viable block of politically aware and active members of everyday
American, and Texan society.
Today we are very concerned about any and all laws that may be enacted which hinder our rights to ride free, enjoy, and choose to pursue our love of riding whether it is as members of the hundreds of various motorcycle clubs, motorcycle ministries, or as independent riders.
Throughout the United States, and certainly Texas, we as bikers are
under attack legislatively across the board in efforts to diminish our
biking rights.
So today I am petitioning you to please reconsider your position on
mandatory helmet laws across this nation. I do not support such a law,
and neither will I support any legislator at any level who embraces, or
endorses any such helmet law. And I will do my best to see that any
legislator who does so does not remain in office for long.

We cannot allow the continuation of the trampling on our Constitutional rights. This is an outright discriminatory act that must be stopped. A few members of Congress agree. A letter from Congress was sent by James Sensenbrenner from Wisconsin to Ray Lahood asking him to suspend NHTSA’s program until the concerns of motorcyclists were addressed by Oct 13, 2010.
The only Rep from Texas to sign on it was Ron Paul out of Houston,TX.
If Ron Paul is your Rep, then please send him a Thank You letter.

Phillip Allen Traweek was born in Evanston, Illinois on June 4, 1947 to Mary Ellen Hanson and Robert Traweek. He was raised Carrizo Springs, Texas. He is survived by his wife Joyce Oche of Austin, two brothers and one sister; Mark Ayers of San Antonio, Texas; Jim Traweek of Springfield, Virginia; and Roxann Langston of Riverside, Texas. He is also survived by three step sisters; Nancy King, Judy Sexton, and Kathy Beauchamp. He was the proud father of four daughters; Kari Schuster of Gulfbreeze, Florida; Laura Schreiber of Dorsten, Germany; Dawn Landry of North Providence, Rhode Island; and Kassandra Traweek of Beavercreek, Ohio. He is survived by five grandchildren and numerous nieces, nephews and cousins.

He became member of the U.S. Navy in 1965 He served his country proudly for 3 years and was awarded the National Defense Service Medal and the Vietnam Service Medal with one campaign star. He worked locally doing Custom Construction, Motorcycle Repair and Missions of Mercy and Mayhem as he put it on his business card.
August 1, 2010: Madhatter, as he was known to his friends, was involved in a motorcycle accident in Columbus, TX he suffered massive head injury and on August 26th at 9:50 a.m. he passed away at Breckenridge Hospital in Austin Texas.
There will be a memorial service to celebrate the life of Mad Hatter on September 11th at VFW Post 8787; 500 VFW Drive; Austin Texas from 4:00 PM to 7:00 PM.
According to some people that we have spoken to Hatter was The most photographed biker in the world. He appeared in every edition of the Easy Rider magazine at least once and sometimes more for years.

Lewisville’s 12th annual Toys 4 Tots Motorcycle Toy Run, benefiting children of Denton County, will take place on December 4, 2010. On-site registration will begin at 9am in front of City Hall at 151 W. Church St. in Lewisville. The Motorcycle Parade will begin promptly at 12pm in front of City Hall, and will end there around 12:30pm. After the parade, riders will enjoy a complimentary lunch and festivities at the Holiday at the Hall festival in Old Town Lewisville. Be sure to bring an unwrapped toy worth $10 or more, or provide a $10 donation on-site to one of Denton’s local charities, when you register for the event.

5/27/2010 between 4am & 9am someone cut two 1/4 inch chains and stole our 3/4 Chopper from Windsor Court Apartment Complex on East Southwest Parkway in Lewisville.
The bike is a Homebuilt 3/4 chopper, red in color. See attached pictures.
They knew this would be easy to steal and hard to trace, as we had not gotten it registered yet.

The Tater Motorcycle Rally will also be having a huge auction, raffle tickets, vendors, as well as a dunk a cop booth, and tons more. This event is hosted by the circuit riders, and the Freedom Riders. Tickets for the Tater motorcycle rally are $15.00 for singles and $20.00 for couples. Los Paisanos M/C, Ingleside is hosting our 4th annual Butterfly Run on
July 12th. For this run our chapter finds a local child who suffers from cancer, and raises money for their medical cost. Literally 100% of the proceeds go to the family, all expenses for the run come from donations, or at cost to the M/C. This year there will be two children which is a first for us, so we are hoping for a huge turnout.

Last year, more than 5,000 people were killed in motorcycle crashes in the US. That was a record since gathering of motorcycle accident data began in 1975. A new study by the Insurance Institute for Highway Safety shows that motorcycles that come equipped with antilock braking systems, may have a much higher chance of avoiding a collision when the brakes are applied.
Antilock brakes work by preventing the wheels of the motorcycle from locking when a motorcyclist brakes. If the wheels lock suddenly when a motorcyclist brakes at high speeds, the bike could be sent flipping with serious injuries or fatalities to the motorcyclist. The IIHS study showed that the risk of an accident dropped by approximately 37% when the motorcycle came equipped with these antilock brakes.
Not only that, according to a separate study by the Highway Loss Data Institute, the number of motorcycle damage claims dropped by 22% in case of motorcycles that included antilock brakes, compared to motorcycles that did not come with these braking systems. More motorcycle manufacturers are including antilock braking systems in their vehicles, and approximately 60 models currently in the market come with these features.
Obviously, antilock braking systems will not help rear end collisions, skidding and other types of motorcycle accidents. These however will be very useful in preventing a crash where the motorcyclist has to brake suddenly. As Houston motorcycle accident lawyers, our biggest piece of advice to a motorcyclist would be to always wear an approved helmet. Wearing a helmet reduces your chance of suffering a serious or fatal brain injury in a crash. Perhaps it is now time to add another piece of advice to that brief list- Buy a motorcycle with antilock brake systems.
Houston car accident attorneys encourage consumers in Houston and Texas to buy cars that come equipped with electronic stability control systems, side airbags and other safety features. We should also be encouraging motorcyclists to buy motorcycles based on the presence of safety features.

It’s good the city of Galveston intends to review its noise ordinances.
Police Chief Charles Wiley makes a compelling argument that the existing ordinances are vague and subjective.
For example, the city’s ordinance now states “unreasonably loud, disturbing or unnecessary” noises are prohibited, particularly between 10:30 p.m. and 7 a.m.
The ordinance doesn’t define what constitutes an unreasonably loud noise, however, leaving officers and municipal-court judges to make that determination.
Violations are in the ears of the beholder, in other words.
It would be hard to write a law to be more subjective than that.
Apparently, for example, older police officers tend to find music to be unreasonably loud, disturbing or unnecessary at levels of volume lower than do younger officers.
It wouldn’t be surprising to learn the genre of music also made a difference in perception both among police officers and the public.
Wiley suggests equipping police officers with decibel meters, which some cities have done to police noise pollution since the early 1980s.
It’s a simple proposition.
The city council would have to decide what decibel level of noise is unreasonably loud and disturbing and codify that in an ordinance.
Then, if noise registers greater than number “X” decibels on a meter “Y” feet from the source, it violates the code. If not, it doesn’t.
Wiley’s idea is a good one. The city council ought to approve it.
We’d also suggest no discussion about noise pollution will be complete without addressing motorcycle noise.
It’s gotten so that a lot people feel comfortable riding very loud motorcycles all across the island at any time of the day and night.
That is a hard problem to police, no doubt. There might not be a good solution, but it would be an interesting topic for the city council to explore.

Half of motorcyclist don’t wear helmets by Audrie Palmer Midland Reporter-Telegram Published: Wednesday, May 26, 2010 9:48 PM CDT While many local motorcyclists complain about how uncomfortable helmets are to wear, local law enforcement officers still encourage bikers to wear them — and said they recently would have prevented some serious injuries in crashes.
A 51-year-old Midland man, Jose Rangel, remained in critical care at Midland Memorial Hospital Wednesday after he was struck at a low rate of speed early Saturday morning while turning into his driveway.
Police said his friend following him was traveling less than 20 mph and struck him from behind. Rangel fell off the bike and hit the curb; the fall caused major brain injuries and some spinal injury, MPD Lt. Brian Bogart said.
Both Rangel and his friend Douglas Randal were both not wearing helmets when the accident happened around 1:30 a.m. in the 400 block of Spruce.
"That’s a prime example where it would have benefited," Bogart said.
In about half of the accidents police work that involve motorcycles, the drivers aren’t wearing helmets. Bogart said those collisions, where the riders were injured or killed because of blunt force trauma to the head, would be the most beneficial to a rider if he or she had been wearing a helmet.
"It depends on how you hit the ground and strike your head on the ground. It doesn’t have to be at a very high speed at all to do some major damage," he said. "If there are traumatic chest injuries, it’s not going to make a big difference if they’re wearing a helmet or not."
But local bikers say helmets are hot and heavy and are grateful that in Texas, a motorcyclist over the age of 21 years old does not have to legally wear one when on a bike.
However, those who do not wish to wear one must either take a motorcycle safety riding course or have a coverage of at least $10,000 for personal injury on their insurance plan to legally not be required to wear one on the road, said Walter Dunn, owner of Walter Dunn’s Insurance Sales.
"The best thing to do to not want to wear a helmet is take that safety course," he said. "It’s the cheapest way."
Dunn has been selling motorcycle insurance the past 28 years and said he has seen the laws for helmet use change several times — requiring riders to wear one at all times, then not, then to wear one again, then to the most recent law.
But, he thinks the laws will change again and will probably be federally-mandated ones in the future.
In 1997, the Texas Legislature changed the laws regarding motorcycle riders that those 21 and older do not have to wear a helmet and added the personal injury insurance coverage or training course to the requirements to be exempt from wearing a helmet.
Last year, Texas Gov. Rick Perry signed Senate Bill 1967 that went into effect Sept. 1, 2009, to require the Texas Department of Transportation to conduct a continuing public awareness campaign to promote motorcycle safety and to remind drivers to share the road with motorcyclists.
The Texas Education Agency also must include information pertaining to motorcycles in their curriculum for any driver safety or driver education course.
There are 18 states that currently require all their motorcyclists and bicyclists to wear a helmet when on the streets. Texas is still one of seven states that have the highest age requirements for bikers to wear a helmet with Maine only requiring those age 14 and younger to wear a helmet when riding a motorcycle.

When a 500-strong motorcycle gang thunders into town, Montvale Elementary School’s teachers and pupils open the doors, pull out the kiddie chairs and invite the riders to lunch.
MONTVALE — The first sign the gang was coming was the long cluster of lights visible half a mile down the road — heat rising off U.S. 460 blurred the distant, twinkling headlamps. Then the noise of the engines filled the air.
They rumbled onto the quiet campus of Montvale Elementary School on Thursday, hundreds of bikers on the backs of Harleys and Hondas, BMWs, Yamahas and Suzukis. Scores arrived; scores more followed.
They were the Rolling Thunder riders, making their annual "Run for the Wall," about 500 in all, and they were just in time for lunch.
Most are veterans of the United States Armed Forces and, each year since 1989, they’ve made a cross-country trek from California to the Vietnam Veterans Memorial wall in Washington, D.C., to honor and promote awareness of veterans.
In recent years, they’ve stopped at Montvale. There’s a friendship between pupils and riders that grows a little with each visit.
"In 2001, we just stood on the road and watched them drive by," said school librarian Meredith Dooley.
The next year, she said, they cruised around the parking lot. Gradually, the visits became an annual afternoon of fellowship between the young students and the more-or-less grizzled vets.
"It’s mainly a history lesson about veterans and some of the accomplishments of the armed forces," said Steve Hill, a retired Marine from Arizona who’s part of the leadership team.
The school’s 300 students get credit for the event and for projects they prepare. An assembly is held in honor of the event and, on Thursday, the school was visited by Brig. Gen. Robert Tucker of the Virginia National Guard, who arrived in a UH-60 Blackhawk helicopter.
Tucker, who viewed the procession from the air, told coordinator Ray "Too Tall" McDonnell, "I’ve never seen a line of motorcycles that long."
Before they ate, the riders — predominantly large, bearded bikers in black leather, denim and bandannas — were asked to form a single file in the cafeteria and were led in groups by student council members to classrooms, where they ate their box lunches at tables that offered a pretty tight fit.
"Did you pass this grade or flunk it?" teased Richard "Preacher" Moore, assistant route coordinator, as he watched hungry cohorts being led into the library to eat.
"The folks that have been here before know how it works," said Dooley, who helped coordinate. "The new ones, we really try to get them out to the classrooms. Then we put them everywhere else we can. We were bursting at the seams today."
Hill said the convoy left California eight days ago with about 400 bikers.
"On average, we’ll pick up a few hundred along the way," he explained. "Our numbers have increased, even with the economy. A lot of people make this their vacation."
Some bring along family, friends or pets. One bike, a three-wheeled Martin Conquest, was even custom-fitted to be wheelchair accessible.
"We run this in platoon formation because most of us are military," Moore said. There are about seven platoons with at least 50 riders per group. Every year he’s ridden, Moore said, the bikers have been joined in their pilgrimage by Vietnam vets who have never seen their war’s memorial.
"It gets rough sometimes," he said. "Sometimes, they just have to stand there and cry."
"Run for the Wall" riders visited Salem on Thursday night and are scheduled to assemble at the American Legion on Apperson Drive and leave for Arlington today at 7:30 a.m.
